Threat to physical and psychological integrity

Moral concepts cover a variety of constantly changing notions. They include everything that threatens the physical and psychological integrity of a person and considered to be inappropriate for the person's age. Any or all types of sexual harassment also form part of this concept.

Employers have a duty to help and assist their employees. They thus have a particular responsibility in protecting the moral integrity of apprentices. The Employment Act (EmpA, SR 822.11) also provides for such responsibility. Serious abuses fall within the scope of the Swiss Criminal Code (SCC, SR 311.0); sentencing is much more severe in cases when infractions occur to a person placed in a subordinate position (e.g. infractions against a minor).

The cantonal authority must ensure that the learner is not threatened in the host company. If this principle is breached, VET accreditation may be withdrawn.
